SAFETY & REPORTING POLICY

Platform: VenueVibe App

1. IMPORTANT EMERGENCY NOTICE

VenueVibe App is a social networking platform. VenueVibe App is not an emergency service.

If you believe you or someone else is in immediate danger, or if there is an emergency involving threats, violence, injury, stalking, sexual assault, or criminal activity, call 911 immediately or contact local law enforcement.

VenueVibe App does not provide emergency response, security services, law enforcement services, medical assistance, or crisis intervention.

2. PURPOSE OF THIS POLICY

VenueVibe App is designed to help adults connect with other users who may be attending the same venue, event, location, or social setting.

This Safety & Reporting Policy explains:

•User safety responsibilities

•Prohibited conduct

•Reporting procedures

•VenueVibe App's rights to investigate, restrict, suspend, or terminate accounts

•Important disclaimers and limitations regarding user interactions

By creating an account or using VenueVibe App, you agree to this Safety & Reporting Policy, the Terms of Service, Privacy Policy, Community Guidelines, Subscription Terms, and any other policies provided by VenueVibe App.

3. OPERATOR IDENTITY

VenueVibe App is owned and operated by JayWorld App LLC, a limited liability company organized under the laws of the State of New York, with its principal place of business in Newburgh, New York (Orange County). JayWorld App LLC is a wholly owned subsidiary of JayWorld Enterprise LLC, a Wisconsin limited liability company.

All rights, obligations, and liabilities described in this policy are those of JayWorld App LLC as the operating entity of VenueVibe App.

4. AGE REQUIREMENT

VenueVibe App is only for users who are eighteen (18) years of age or older.

By using VenueVibe App, you represent and confirm that:

•You are at least 18 years old

•You are legally eligible to use the platform

•You will not permit any minor to use your account

•You will not create an account using false age information

VenueVibe App reserves the right to request proof of age or identity at any time. Accounts that cannot verify eligibility may be suspended or terminated.

5. USE AT YOUR OWN RISK

You understand and agree that use of VenueVibe App is at your own risk.

VenueVibe App does not guarantee:

•The identity of any user

•The intentions, character, or conduct of any user

•The truthfulness of user profiles, photos, relationship status, or statements

•The safety of any online or in-person interaction

•The safety, security, condition, or suitability of any venue, event, location, or business listed on or selected through the App

Users are solely responsible for their own decisions, communications, meetings, and interactions, whether online or in person.

6. NO BACKGROUND CHECK OR VERIFICATION GUARANTEE

VenueVibe App does not conduct criminal background checks, identity verification, employment verification, relationship status verification, or full age verification on all users.

VenueVibe App does not guarantee that any user is truthful, safe, law-abiding, single, available, or accurately representing themselves.

You are responsible for exercising caution, good judgment, and personal safety when communicating with or meeting other users.

7. USER SAFETY GUIDELINES

VenueVibe App strongly recommends that all users follow these safety practices:

•Meet only in public, well-lit places

•Tell a trusted friend or family member where you are going

•Keep your phone charged and available

•Arrange your own transportation

•Do not rely on someone you just met for a ride home

•Trust your instincts

•Leave immediately if something feels unsafe or uncomfortable

•Never share your home address, financial information, passwords, Social Security number, banking information, or private personal information

•Preserve screenshots, messages, usernames, photos, dates, times, and other evidence of concerning conduct

•Report suspicious or unsafe behavior immediately

8. PROHIBITED CONDUCT

Users may not engage in any of the following conduct on or through VenueVibe App:

•Harassment, bullying, intimidation, or threats

•Stalking or unwanted repeated contact

•Hate speech or discriminatory conduct

•Sexual harassment or sexual misconduct

•Human trafficking, exploitation, or coercion

•Child exploitation or any conduct involving minors

•Impersonation or fake accounts

•Fraud, scams, phishing, or financial exploitation

•Posting false, misleading, or deceptive information

•Sharing explicit, abusive, threatening, or unlawful content

•Promoting violence, illegal activity, or self-harm

•Using the App to solicit prostitution, escort services, drugs, weapons, or illegal services

•Recording, photographing, or sharing another user's content without consent

•Attempting to bypass safety tools, blocks, bans, or account restrictions

•Using bots, scraping tools, fake accounts, or automated systems

•Any conduct that VenueVibe App determines may create risk, harm, liability, or reputational damage

VenueVibe App maintains a zero-tolerance policy for threats, harassment, sexual exploitation, human trafficking, child exploitation, hate speech, violence, and unlawful conduct.

9. FOSTA-SESTA COMPLIANCE

VenueVibe App expressly prohibits the use of its platform to facilitate, promote, advertise, or enable sex trafficking, prostitution, or sexual exploitation of any person in violation of federal law, including the Fight Online Sex Trafficking Act (FOSTA) and the Stop Enabling Sex Traffickers Act (SESTA).

VenueVibe App is not designed, marketed, or intended to be used as a platform for soliciting, offering, or arranging sexual services. Any user who uses VenueVibe App for such purposes violates this policy and applicable federal law.

VenueVibe App reserves the right to report suspected trafficking or exploitation activity to the National Center for Missing and Exploited Children (NCMEC) and law enforcement authorities.

10. REPORTING MISCONDUCT

Users may report misconduct, safety concerns, suspicious activity, or violations of this policy.

Reports may include:

•Harassment

•Threats

•Stalking

•Impersonation

•Fraud or scams

•Inappropriate messages

•Sexual misconduct

•Unsafe behavior

•Fake profiles

•Venue-related safety concerns

•Violations of Community Guidelines

Reports may be submitted through:

•In-app reporting tools

When submitting a report, users should provide as much information as possible, including usernames, screenshots, messages, dates, times, locations, and any other evidence.

11. EMERGENCY AND LAW ENFORCEMENT REPORTING

If a situation involves immediate danger, violence, threats, sexual assault, stalking, suspected trafficking, criminal activity, or risk of serious harm, you should contact 911 or local law enforcement immediately.

VenueVibe App may, in its discretion, cooperate with law enforcement, respond to lawful legal requests, preserve account information, or disclose information where permitted or required by law.

12. NO DUTY TO MONITOR — SECTION 230 NOTICE

VenueVibe App does not actively monitor all user activity, messages, communications, venues, events, or interactions and is not obligated to do so.

VenueVibe App reserves the right, but does not assume the obligation, to review, investigate, remove content, restrict access, suspend accounts, terminate accounts, or take other action when it believes a user has violated this policy or created risk to the platform or other users.

VenueVibe App is an interactive computer service as defined under Section 230 of the Communications Decency Act (47 U.S.C. § 230). VenueVibe App is not the publisher or speaker of any user-generated content and is not liable for content posted, transmitted, or shared by users of the platform.

13. ACCOUNT SUSPENSION AND TERMINATION RIGHTS

VenueVibe App may suspend, restrict, disable, or permanently terminate any account at any time if VenueVibe App believes, in its sole discretion, that the user:

•Violated this Safety & Reporting Policy

•Violated the Terms of Service or Community Guidelines

•Created a safety risk

•Engaged in unlawful, abusive, fraudulent, or harmful conduct

•Provided false information

•Misused the platform

•Caused or threatened harm to another user, the public, a venue, or VenueVibe App

No Refund Upon Termination for Cause: If an account is suspended or terminated due to a violation of this policy or the Terms of Service, the user forfeits any unused portion of their subscription period and is not entitled to a refund of any subscription fees paid.

VenueVibe App may take action with or without prior notice.

14. FALSE REPORTS

Users may not knowingly submit false, misleading, exaggerated, or malicious reports against another user.

False reporting may result in account suspension, termination, or other action deemed appropriate by VenueVibe App.

15. VENUE DISCLAIMER

VenueVibe App may allow users to connect based on venues, events, businesses, establishments, or locations.

Unless expressly stated in writing, VenueVibe App is not affiliated with, endorsed by, sponsored by, partnered with, or responsible for any venue, restaurant, bar, nightclub, event, business, organizer, promoter, or location displayed, selected, or referenced through the App.

VenueVibe App is not responsible for:

•Venue security

•Venue staff

•Venue policies

•Venue conditions

•Event cancellations

•Crowd behavior

•Parking

•Transportation

•Alcohol service

•Injuries or incidents occurring at any venue or event

Users attend venues and events at their own risk.

16. USER RESPONSIBILITY

Each user is solely responsible for:

•Their own communications

•Their own conduct

•Their own decisions to meet another user

•Their own personal safety

•Their own transportation

•Their own compliance with applicable laws

•Their own interactions inside or outside the App

VenueVibe App is not responsible for the actions, conduct, statements, omissions, or behavior of any user.

17. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless JayWorld App LLC, its parent company JayWorld Enterprise LLC, and their respective members, managers, officers, employees, contractors, agents, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

•Your use of VenueVibe App

•Your violation of this Safety & Reporting Policy, the Terms of Service, Community Guidelines, or any applicable law

•Your conduct, communications, or interactions with other users, venues, or third parties

•Any content you post, transmit, or share through the App

•Any claim by a third party arising from your use of the platform

VenueVibe App reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with VenueVibe App's defense of such claims.

18. DISCLAIMER OF WARRANTIES

VenueVibe App is provided on an "as-is" and "as-available" basis without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, JayWorld App LLC expressly disclaims all warranties, including but not limited to:

•Implied warranties of merchantability and fitness for a particular purpose

•Warranties of title or non-infringement

•Any warranty that the App will be uninterrupted, error-free, secure, or free of viruses or harmful components

•Any warranty regarding the accuracy, completeness, or reliability of any content or information on the platform

No advice or information, whether oral or written, obtained from VenueVibe App or through the platform, shall create any warranty not expressly stated herein.

19. LIMITATION OF LIABILITY

To the fullest extent permitted by law, VenueVibe App, JayWorld App LLC, its parent JayWorld Enterprise LLC, and their respective owners, officers, employees, contractors, agents, affiliates, successors, and assigns shall not be liable for any harm, injury, loss, damage, emotional distress, financial loss, personal injury, death, criminal act, misconduct, dispute, or other claim arising from:

•Use of the App

•Communications between users

•Meetings between users

•In-person interactions

•Venue attendance

•Events or locations selected by users

•User-generated content

•False or misleading user information

•Conduct by any third party

In no event shall JayWorld App LLC's total liability to any user for any claim exceed the greater of (a) the amount paid by the user to VenueVibe App in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100.00).

Users agree that they use VenueVibe App voluntarily and at their own risk.

20. DISPUTE RESOLUTION AND ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Binding Arbitration: Except for claims that may be brought in small claims court, any dispute, claim, or controversy arising out of or relating to this policy, the Terms of Service, the App, or your use of VenueVibe App shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

Class Action Waiver: YOU AND VENUEVIBE APP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Arbitration Location: Arbitration shall take place in Orange County, New York, or remotely if agreed upon by the parties.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to JayWorld App LLC within thirty (30) days of first accepting these terms. Opting out does not affect any other part of this policy.

21. GOVERNING LAW AND JURISDICTION

This Safety & Reporting Policy and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

To the extent any claim or dispute is not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Orange County, New York, and waive any objection to the laying of venue in such courts.

22. POLICY UPDATES

VenueVibe App may update this Safety & Reporting Policy at any time. For material changes, VenueVibe App will provide at least seven (7) days' notice by posting in the App, on the website, or by email before the changes take effect. Non-material changes may take effect immediately upon posting.

Continued use of VenueVibe App after updates are posted or after the notice period expires means you accept the updated policy.

Please read and check each item below before submitting.

☐Emergency Disclaimer: I understand that VenueVibe App is not an emergency service and that I must call 911 in an emergency.

☐Use at Own Risk: I understand that I use VenueVibe App and meet other users at my own risk.

☐No Background Checks: I understand that VenueVibe App does not guarantee background checks, identity verification, relationship status verification, or user safety.

☐User Responsibility: I understand that I am responsible for my own interactions, communications, meetings, and personal safety.

☐Prohibited Conduct: I understand the prohibited conduct listed in this policy and agree not to engage in any such conduct.

☐Venue Disclaimer: I understand that VenueVibe App is not responsible for venues, events, businesses, locations, or conditions at places where users may meet.

☐No Duty to Monitor: I understand that VenueVibe App does not monitor all user activity and is not obligated to do so.

☐Indemnification: I agree to indemnify and hold harmless JayWorld App LLC from claims arising from my conduct on or through VenueVibe App.

☐Disclaimer of Warranties: I understand that VenueVibe App is provided as-is without warranties of any kind.

☐Limitation of Liability: I understand that VenueVibe App is not liable for harm, injury, loss, or damage resulting from user interactions, whether online or in person.

☐Arbitration & Class Action Waiver: I understand and agree that disputes will be resolved by binding individual arbitration and that I waive the right to participate in a class action.

☐Governing Law: I understand that this policy is governed by the laws of the State of New York, Orange County jurisdiction.

☐Age Requirement: I confirm that I am at least eighteen (18) years old and legally eligible to use VenueVibe App.

☐Policy Updates: I understand that VenueVibe App may update this policy and that continued use of the platform means I accept those updates.

☐I Agree to the VenueVibe App Safety & Reporting Policy

By submitting this acknowledgment, I confirm that I have read, understood, and agreed to this Safety & Reporting Policy. I understand that my name, email address, date, and timestamp may be recorded for compliance and legal purposes.
