CHILD SAFETY, ANTI-TRAFFICKING & ILLEGAL ACTS POLICY

This Child Safety, Anti-Trafficking & Illegal Acts Policy ("Policy") describes how JayWorld App LLC, operating VenueVibe App ("VenueVibe App," "Company," "we," "our," or "us"), identifies, prevents, reports, and responds to child sexual abuse material (CSAM), human trafficking, sexual exploitation, and other illegal acts conducted through or facilitated by the platform.

This Policy is incorporated by reference into the Terms of Service, Safety & Reporting Policy, Privacy Policy, and Community Guidelines. By using the Service, you agree to this Policy in full.

1. OPERATOR IDENTITY

VenueVibe App is owned and operated by JayWorld App LLC, a limited liability company organized under the laws of the State of New York, with its principal place of business in Newburgh, New York (Orange County). JayWorld App LLC is a wholly owned subsidiary of JayWorld Enterprise LLC, a Wisconsin limited liability company.

All obligations under this Policy are those of JayWorld App LLC as the operating entity of VenueVibe App.

2. ZERO TOLERANCE POLICY

VenueVibe App maintains a strict zero-tolerance policy toward the following conduct on or through the platform:

•Child Sexual Abuse Material (CSAM) or any sexual content involving minors

•Sexual exploitation, grooming, or enticement of minors

•Human trafficking and sex trafficking of any person

•Sexual violence, coercion, or non-consensual sexual content

•Prostitution solicitation or escort solicitation

•Fraud, financial exploitation, or scams targeting users

•Any other illegal act conducted through, facilitated by, or arranged through the platform

Violations of this Policy will result in immediate, permanent account removal, device and payment-method bans, and referral to law enforcement and applicable reporting bodies.

3. AGE REQUIREMENT AND COPPA COMPLIANCE

VenueVibe App is strictly for adults who are eighteen (18) years of age or older. Users confirm they are at least 18 years old at signup and at the time of any subscription purchase.

COPPA Compliance: VenueVibe App does not knowingly collect personal information from children under 13 years of age, consistent with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506. If we discover that a user account belongs to a child under 13, that account and all associated personal data will be deleted within 72 hours of discovery, except where preservation is required by law enforcement or legal process.

If a user is discovered to be between 13 and 17 years of age, the account will be terminated immediately and data handled consistent with applicable law.

Parents or guardians who believe a child has created an account or submitted personal information should contact us immediately at safety@venuevibeapp.com.

4. FOSTA-SESTA COMPLIANCE

VenueVibe App expressly prohibits the use of its platform to facilitate, promote, advertise, or enable sex trafficking, prostitution, or sexual exploitation of any person in violation of federal law, including the Fight Online Sex Trafficking Act (FOSTA) and the Stop Enabling Sex Traffickers Act (SESTA).

VenueVibe App is not designed, marketed, or intended to be used as a platform for soliciting, offering, or arranging sexual services of any kind. Any user who uses the platform for such purposes:

•Violates these Terms and applicable federal law

•Will have their account immediately and permanently terminated

•May be reported to NCMEC and law enforcement

•May be subject to civil and criminal liability

5. IDENTIFICATION AND DETECTION PROTOCOLS

VenueVibe App uses a combination of automated and human review systems to identify prohibited content and behavior, including:

•AI-assisted moderation of reports and message content, classifying material into categories including CSAM, trafficking, sexual violence, and illegal activity

•Automatic blocking of users where AI-assessed severity is high or critical

•Human review of all reports submitted through the in-app reporting tool

•Verified live-selfie checks at check-in to deter impersonation and bot accounts

•Pattern detection for grooming language, trafficking recruitment scripts, and references to minors

•Device and payment-method fingerprinting to prevent re-registration by banned users

No Guarantee of Detection: These systems are designed to reduce harmful conduct but do not guarantee detection or prevention of all prohibited activity. VenueVibe App is not liable for prohibited conduct that occurs despite these measures.

6. USER REPORTING

Any user may report another user through the in-app Report dialog. Dedicated report categories include:

•Child exploitation / CSAM

•Human or sex trafficking

•Sexual violence or non-consensual content

•Illegal activity

•Underage user

•Harassment or threats

•Fraud or scam

Reports are reviewed by automated safety systems in real time and escalated to our safety team for human review where warranted.

When submitting a report, provide as much detail as possible, including usernames, screenshots, messages, dates, times, and any other relevant information.

7. EMERGENCY AND LAW ENFORCEMENT REPORTING

If you witness or are a victim of any illegal act — including CSAM, trafficking, sexual violence, or fraud — contact law enforcement immediately. In the United States, dial 911.

8. NCMEC REPORTING OBLIGATIONS

VenueVibe App will report apparent CSAM to the National Center for Missing & Exploited Children (NCMEC) CyberTipline as required by 18 U.S.C. § 2258A. Failure to report known CSAM is a federal crime. VenueVibe App takes this obligation seriously and will err on the side of reporting when there is any reasonable suspicion of CSAM.

CSAM-related records, account data, and evidence will be preserved consistent with NCMEC reporting requirements and applicable law enforcement requests.

9. LAW ENFORCEMENT COOPERATION

VenueVibe App cooperates with valid legal requests from law enforcement. We preserve relevant account data and content when required by law, consistent with 18 U.S.C. § 2703(f) (90-day preservation upon request, with one 90-day extension).

Emergency disclosure requests involving credible risk of imminent danger to a child or any person are treated as the highest priority, consistent with 18 U.S.C. § 2702(b)(8).

VenueVibe App may also proactively refer information to law enforcement where we have a good-faith belief that a user has committed or is about to commit a serious crime involving a child or another person.

10. ENFORCEMENT ACTIONS

Confirmed violations of this Policy result in:

•Immediate and permanent account removal without notice or refund

•Device identifier and payment-method fingerprint bans to prevent re-registration

•Referral to law enforcement and applicable reporting bodies (including NCMEC)

•Preservation of relevant account data for law enforcement use

•Cooperation with civil and criminal proceedings as required by law

VenueVibe App reserves the right to take action based on reasonable suspicion even where a violation has not been confirmed, where delay may result in harm to a child or other person.

11. NO DUTY TO MONITOR

VenueVibe App does not actively monitor all user activity, messages, or content in real time and is not obligated to do so.

VenueVibe App is an interactive computer service as defined under Section 230 of the Communications Decency Act (47 U.S.C. § 230). The Company is not the publisher or speaker of user-generated content. However, Section 230 does not provide immunity for federal sex trafficking claims under FOSTA-SESTA, and VenueVibe App takes its obligations under that law seriously.

The existence of safety systems described in this Policy does not create a duty to detect or prevent all prohibited conduct, and VenueVibe App is not liable for prohibited conduct that occurs despite these measures.

12. FALSE REPORTS

Users may not knowingly submit false, misleading, or malicious reports against another user. False reporting may result in account suspension or termination.

However, VenueVibe App will never penalize a user for a good-faith report of suspected child exploitation, trafficking, or illegal activity, even if the report does not result in confirmed findings.

13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless JayWorld App LLC, its parent JayWorld Enterprise LLC, and their respective members, managers, officers, employees, contractors, agents, successors, and assigns from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

•Your violation of this Policy, the Terms of Service, or applicable law

•Your conduct on or through the platform that constitutes or facilitates illegal activity

•Any CSAM, trafficking-related, or other illegal content you submit, share, or facilitate through the Service

•Any claim by a third party, law enforcement, or regulatory body arising from your use of the platform

14. DISCLAIMER OF WARRANTIES

VenueVibe App's child safety, anti-trafficking, and moderation systems are provided on an "as-is" and "as-available" basis without warranty of any kind. JayWorld App LLC disclaims all warranties, express or implied, including but not limited to any warranty that safety systems will detect all prohibited content, that no prohibited conduct will occur on the platform, or that moderation will be error-free or complete.

This Policy describes app-visible controls and reporting commitments. It is not a certification or a guarantee of outcomes.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, JayWorld App LLC, its parent JayWorld Enterprise LLC, and their respective members, managers, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to prohibited conduct by other users, failure to detect prohibited content, or any harm caused by a third party through the platform.

In no event shall JayWorld App LLC's total liability for any claim under this Policy exceed the greater of (a) the amount paid by you to VenueVibe App in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100.00).

Nothing in this limitation of liability section limits the Company's obligations under applicable federal law, including NCMEC reporting requirements under 18 U.S.C. § 2258A.

16. DISPUTE RESOLUTION AND ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Binding Arbitration: Except for claims that may be brought in small claims court, any dispute arising out of or relating to this Policy or your use of VenueVibe App shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

Class Action Waiver: YOU AND VENUEVIBE APP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

Arbitration Location: Arbitration shall take place in Orange County, New York, or remotely if agreed upon by the parties.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to JayWorld App LLC within thirty (30) days of first accepting these terms.

17. GOVERNING LAW AND JURISDICTION

This Policy shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions, and applicable federal law including 18 U.S.C. § 2258A, 18 U.S.C. § 2703(f), FOSTA-SESTA, and COPPA.

To the extent any claim or dispute is not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Orange County, New York, and waive any objection to the laying of venue in such courts.

18. POLICY UPDATES

VenueVibe App may update this Policy at any time. For material changes, VenueVibe App will provide at least seven (7) days' advance notice by posting in the App, on the website, or by email before changes take effect. Non-material changes may take effect immediately upon posting.

Continued use of the Service after the notice period expires constitutes acceptance of the updated Policy.

Please read and check each item below before submitting.

☐Zero Tolerance: I understand that VenueVibe App has a zero-tolerance policy toward CSAM, human trafficking, sexual exploitation, and illegal acts, and that violations result in immediate permanent account removal.

☐Age Requirement: I confirm that I am at least eighteen (18) years old and legally eligible to use VenueVibe App.

☐COPPA: I understand that VenueVibe App does not knowingly collect data from children under 13 and that underage accounts are deleted within 72 hours of discovery.

☐FOSTA-SESTA: I understand that VenueVibe App prohibits use of the platform to facilitate sex trafficking or prostitution and that such use violates federal law.

☐Identification Protocols: I understand that VenueVibe App uses automated and human review systems to detect prohibited content and behavior.

☐User Reporting: I understand how to report prohibited conduct through the in-app reporting tool and by email, and I agree to report suspected CSAM, trafficking, or illegal activity.

☐Emergency Resources: I understand that I must contact 911 in an emergency and that I have access to NCMEC, the National Human Trafficking Hotline, and RAINN for additional reporting.

☐NCMEC Reporting: I understand that VenueVibe App is legally required to report apparent CSAM to NCMEC under 18 U.S.C. § 2258A.

☐Law Enforcement Cooperation: I understand that VenueVibe App cooperates with valid law enforcement requests and may preserve and disclose account data as required by law.

☐Enforcement: I understand that confirmed violations result in immediate permanent account removal, device bans, and law enforcement referral with no refund.

☐No Duty to Monitor: I understand that VenueVibe App does not monitor all user activity and is not liable for prohibited conduct that occurs despite safety systems.

☐Indemnification: I agree to indemnify and hold harmless JayWorld App LLC from claims arising from my violations of this Policy or illegal conduct on the platform.

☐Disclaimer of Warranties: I understand that safety systems are provided as-is and are not a certification or guarantee of outcomes.

☐Limitation of Liability: I understand that JayWorld App LLC's liability for claims under this Policy is limited as described herein.

☐Arbitration & Class Action Waiver: I understand and agree that disputes will be resolved by binding individual arbitration and that I waive the right to participate in a class action.

☐Governing Law: I understand that this Policy is governed by the laws of the State of New York, Orange County jurisdiction, and applicable federal law.

☐Policy Updates: I understand that VenueVibe App may update this Policy and that continued use constitutes acceptance of changes.
